Fatal blow ‘unknown’

A 20-year-old who punched and kicked a dying man on the pavement was sentenced to 200 hours community service by a judge who ruled that he could not have known that his victim’s injuries were fatal.
Kristof Jaworski, of Maitland Park, was sentenced yesterday (Wed) after pleading guilty to assaulting Lee Moriarty, 27, in Queen’s Crescent, Gospel Oak, last June after a row outside the Costcutters supermarket.
Mr Moriarty sustained fatal brain damage when his head struck the pavement during the clash.
Lee Moriarty had been drinking heavily and had been injured in a fight with his girlfriend when he was ejected from the Costcutters by staff on June 10, Highbury Corner Magistrates Court heard. Mr Moriarty turned his rage on Jaworski and his teenage friends who had just emerged from a fast food restaurant, forcing Jaworski and a friend to defend themselves and fell Mr Moriarity, the judge summarised.
District Judge Henderson told Jaworski: “You were the initial victim. (But) I am quite sure that you attacked him while he was helpless – in fact, dying, though you could not have known that at the time. I accept that you were initially in fear, then overreacted.”
